PEPT Tribunal: What I Would Have Done If I'm A Judge" -Dele Momodu Speaks On 25% Of The FCT

During a live podcast on Twitter with Seun Okin of Channels TV, Dele Momodu discussed the constitutional requirement of securing 25% in the FCT. Momodu shared his perspective on how he would interpret this if he were the judge. He emphasized that the 25% FCT requirement is obligatory and neither Atiku nor Tinubu met it, indicating their failure to meet the requirement.

He explained: “The 25% FCT mandate is compulsory. As neither Atiku nor Tinubu achieved 25%, they fell short of this requirement. In my view, this renders the election inconclusive, leading to the need for a rerun. If I were the judge, this is how I would evaluate it: Peter Obi attained 25% in the FCT, though he lacked sufficient reach across 2/3 of the 36 states. Conversely, Tinubu, like Atiku, didn’t meet the FCT requirement. This outcome makes the election inconclusive, and the judgment should reflect this stance.”
