Tribunal: Election Rerun Can't Take Place If Nigeria Goes To War With Niger – Barrister Eluchie

As Nigerians continue to await the final verdict of the five-man panel of Appeal Court Justices currently presiding over the Presidential Election Petitions Tribunal in Abuja, renowned lawyer, and public affairs commentator, Barrister Eze Eluchie has come out to reveal that a potential war between Nigeria and Niger Republic could prevent any form of election rerun if the court gives such an order.

Speaking during an interview on Voice Of The People FM on Monday, August 7, Eluchie explained that the Constitution prevents Nigeria from holding any form of election if the country is involved in any external conflict with a foreign nation.

According to him, the law gives the sitting President the power to declare a State-Of-Emergency and suspend any electoral process until the conflict is resolved and peace is restored.

He said; “If there is a war in Nigeria, there is a constitutional provision that allows the President, if to declare that elections cannot take place. The President can keep postponing the election. If Nigeria goes into war with the Niger Republic, no matter what the Tribunal says, an election rerun cannot take place based on the provisions of the Constitution. And that would be very unfortunate.

According to Section 135(3) of the Constitution, when Nigeria is at war, or if any part of the country is being attacked, elections can be suspended for at least six months at a time. So, should Nigeria go into war with Niger, we have to forget about the tribunal and its decision for the time being.”
