'Most Judgements That Have Been Delivered Dwells On The Qualifications Of The Candidates' -Liborous Oshoma,

Liborous Oshoma, a Nigerian lawyer, has asserted that a significant portion of election tribunal judgments revolves around candidates’ qualifications. Speaking in an Arise TV news interview, he indicated that this trend might continue into the 2023 election tribunal, particularly in the case of President Bola Tinubu. Oshoma noted that due to the intricate nature of proving irregularities at polling stations, this aspect might not be given as much priority.

Oshoma conveyed, “Many of the judgments rendered have centered on candidates’ qualifications. The court has stipulated that qualifications encompass both pre-election and post-election aspects. As a result, petitioners tend to avoid the strenuous task of proving irregularities at polling units, as it proves to be a daunting challenge.”

Ohoma went on saying, “Instead, they focus on evaluating the candidate’s eligibility. Was the conduct of primaries valid and carried out by the right individuals? Are the certificates presented by the candidates authentic? Or have the certificates been falsified? These are the pivotal concerns they examine.”

Oshoma emphasized that a significant proportion of judgments delivered predominantly address candidates’ eligibility. He added, “The court’s emphasis on eligibility before and after the election has led petitioners to veer away from attempting to establish irregularities at polling units, as it poses formidable obstacles. Instead, their attention is directed toward assessing whether the candidate meets the required qualifications. Central issues include verifying the validity of primary elections, the authenticity of candidates’ certificates, and whether any certificates have been tampered with or forged.”
