You Can Only Question An Election On The Basis Of Non-compliance With The Electoral Act -SAN Kargbo

A Senior Advocate of Nigeria, Sam Kargbo has alleged that the petitioners can only question an election based on non-compliance with the electoral act and not the guidelines of lines. He said this in relation to the judgment being made by the PEPT judges that INEC cannot be forced to upload results. He established the fact that INEC should provide transparency and that if they run short of that in the electoral process, it cannot be used as a ground by the petitioners to challenge the process in court.

He said in an interview with AIT news, ”The issues of ethics and morals resonates very well with the public but within the ambits of the law, they are no issues. The Law is very clear that you can only question an election on the basis of noncompliance with Electoral Act and not the guidelines of INEC. And in any case, if you say on your ground that the election was marred by reason of non-compliance with the electoral act and the regulations of INEC for the elections, that ground is invalid, it’s going to be struck out.

 Because the law does not allow you to amend or be creative, they say you copy what it has already suggested to you. INEC has the derivative to make rules and infuse some transparency and credibility into the process. But if they run short of that, will you make that as a ground for challenging the election? No.”
