Why INEC Failed To Open Defence Against Peter Obi’s Petition On Monday

It is no longer news that the Independent National Electoral Commission on Monday, failed to open its defence against the allegations of rigging levelled by the presidential candidate of the Labour Party, Peter Obi regarding the 2023 presidential election.

It will be recalled that the former Anambra state governor had approached the court to challenge the declaration of President Bola Tinubu as winner of the 2023 presidential election.

In a joint petition he filed with his party, the Labour Party, Peter Obi, argued that Bola Tinubu who was declared winner of the keenly contested presidential election, was not the authentic winner of the election.

After he called several witnesses to testify before the presidential election petition court and tendered several documentary evidence to back up his claims that the election was rigged, Peter Obi closed his case on June 23.

The court however resumed its proceedings on Monday to enable the electoral body call its first witness to prove that president Bola Tinubu was the authentic winner of the presidential election as declared. But, when the case was called for hearing by the court, INEC through its legal team were unable to produce the witness.

The reason why the electoral body was unable to produce its first witness was as a result of some shortcomings. According to INEC, the first person it wanted to put in the witness box was involved in a domestic issue.

As a result of this, the lead counsel to INEC, Mahmoud, SAN, persuaded the five-member panel of the presidential election petition court led by Justice Haruna Tsammani to adjourn further proceedings in the matter till Tuesday.
