Tribunal strikes out suit seeking disqualification of Vice President of Nigeria, Kashim Shettima

According to the report from Channels Television, the Allied Peoples Movement (APM)’s petition challenging double nomination of the Vice President of the Federal Republic of Nigeria, Senator Kashim Shettima has been struck out by the Presidential Election Tribunal in Abuja on Wednesday.

Alhaji Atiku Abubakar of the Peoples Democratic Party (PDP), Peter Obi of the Labour Party (LP), and the Allied Peoples Movement (APM) are challenging President Asiwaju Bola Ahmed Tinubu’s declaration as the winner of the 2023 presidential election.

The party had argued that Asiwaju Bola Ahmed Tinubu was improperly sponsored by the All Progressives Congress, APC, for nominating Senator Kashim Shettima as his vice presidential candidate for the election.

The opposition party had claimed that the Vice President of the Federal Republic of Nigeria, Senator Kashim Shettima was still the All Progressives Congress’ (APC) candidate for Borno Central Senatorial District on July 14 when he accepted the nomination for vice presidential candidate.

However, in a ruling read by Justice Haruna Tsammani, chairman of the panel, on the case on Wednesday, September 6, the PEPT held that it is a pre-election matter, and that it lacked the jurisdiction to entertain the matter.

Justice Tsammani who was reading the lead judgement, further added that section 285(14c), does not allow members of a political party to challenge the nomination of candidates of another political party.

The court also held that Allied Peoples Movement (APM) lacked locus standi to institute matters bothering on nomination and sponsorship of Senator Kashim Shettima.
