Suspended CBN Governor Godwin Emefiele Appeals to Court to Halt Prosecution Amidst Legal Battle

Godwin Emefiele, the suspended Governor of the Central Bank of Nigeria (CBN), has lodged a fresh application before the Federal High Court in Lagos, requesting an order to cease the Federal Government, specifically the Department of State Services (DSS), from pursuing further legal action against him. Emefiele, who was initially arraigned by the DSS on July 25 on charges of illegal firearm possession, was released on bail but subsequently rearrested by the same agency.

As per Vanguard papers on Thursday, August 10, 2023, Emefiele’s legal team, led by Mr. Joseph Daudu, SAN, argued that the DSS’s actions were a “brazen disobedience” of the court’s earlier orders granting Emefiele bail. The suspended governor sought the court’s intervention to discharge him from all charges and prevent the Federal Government from benefiting from any legal proceedings until it complies with the bail ruling.

Emefiele’s legal strategy relied on Section 6(6)(a) of the 1999 Constitution (as amended), pertinent sections of the Administration of Criminal Justice Act, 2015, and the court’s inherent powers. His application sought to temporarily halt the ongoing legal proceedings until the government and DSS adhere to the court’s orders regarding his bail.

In his application, Emefiele emphasized the need to uphold the court’s authority and maintain the rule of law, asserting that he was not willing to be perceived as a “toothless bulldog or paper tiger.” He conveyed his commitment to preserving the “efficacy, majesty, and integrity of the court” in the democratic framework of Nigeria.

The Department of State Services, on the other hand, has responded to Emefiele’s move by contesting his claims. The court is scheduled to hear the fresh application today, where both sides will present their arguments.

Emefiele’s legal battle comes amid heightened scrutiny and speculation surrounding his case. As the former governor of the Central Bank of Nigeria, his actions have long been in the public eye.
