Enugu Guber : We Have No Witness – INEC Tells Tribunal

The Independent National Electoral Commission, INEC, failed to bring any witnesses to defend the election that produced Enugu State Governor Peter Mbah on Wednesday.

According to reports, Chijioke Edeoga, the candidate of the Labour Party, LP, who is disputing Mbah’s victory, closed his case on Sunday. The case was subsequently postponed till yesterday, Tuesday, for the INEC to present its case. When INEC was unable to produce a witness, the case was deferred once more. However, when the Governorship Election Petition Tribunal resumed its sessions in Enugu on Wednesday, the commission was unable to produce any witnesses.

INEC informed the court, through its legal team led by Humphrey Okoli, that the commission had opted not to call any witnesses. “The first respondent (INEC) is mandated to open the case,” Okoli stated. My Lord, following a comprehensive examination of the case, we have decided not to call any witnesses.” The PDP’s counsel, Benjamin Nwosu, and Peter Mbah’s counsel did not oppose INEC. The PDP was also likely to file a complaint.

Despite expressing its determination to submit evidence to defend the outcome of the contested governorship election, the party informed the tribunal that it would want an extension of time to summon their witnesses. As a result, PDP counsel Nwosu persuaded the tribunal to suspend further proceedings in the case for two hours, claiming that he had four days to present his defence.
