PEPT: Many Issues Need More Clarifications in Presidential Tribunal Judgment – Nwobike SAN

During a recent interview with THE PUNCH, Dr. Joseph Nwobike, a Senior Advocate of Nigeria (SAN), provided his perspective on the verdict issued by the Presidential Election Petition Tribunal (PEPT).

Dr. Nwobike emphasized the need for further clarification on several issues and cautioned against premature predictions regarding the outcome of an appeal to the Supreme Court. He stated, “There will inevitably be an appeal to the Supreme Court in this matter due to the numerous issues raised in this ruling that require further clarification for both parties involved in this litigation. However, it is premature to conclude whether the petitioners will prevail at the Supreme Court, and I believe that even the Supreme Court justices would refrain from making such a determination at this time.”

He praised the judgment of the tribunal, describing it as a genuine reflection of the principles governing Nigerian election litigation. He highlighted its foundation in a comprehensive understanding of evidence and legal submissions.

Commenting on the live broadcast of court proceedings, the senior lawyer commended the Court of Appeal for introducing live streaming, emphasizing its role in ensuring transparency. Dr. Nwobike also acknowledged the professionalism of the justices involved.

Dr. Nwobike noted that parties dissatisfied with the judgment retain the right to appeal to the Supreme Court. He highlighted key Tribunal decisions and expressed confidence in the parties’ willingness to respect the court’s rulings.

Regarding the issue of 25% of votes in the Federal Capital Territory (FCT), he supported the Tribunal’s reasoning, emphasizing its role in preventing constitutional crises and practical challenges in electoral processes.
