Kaduna: Tribunal modifies pre-hearing report, as INEC fails to open case against Ashiru, PDP

Justice Victor Owe-led panel, handling the March 18, 2023 gubernatorial election petition Tribunal in Kaduna State has modified the pre-hearing report of the tribunal.

Daily post report that, The modification followed the failure of the Independent National Electoral Commission (INEC) to open its case against the gubernatorial candidate of the Peoples Democratic Party, PDP, Isa Ashiru and his party on Saturday as ordered by the tribunal at the last sitting.

The petitioners’ case was dismissed at the previous meeting because the Commission had previously been unable to turn over the witness who had been subpoenaed.

When the hearings resumed on Saturday, INEC had planned to present its case against the petitioners, but it was unable to do so because its attorney requested a delay so that the Commission’s witnesses could come before the tribunal.

“The witnesses we plan to summon are preparing for promotions. The lawyer for INEC asked for further amendment of the pre-hearing report, saying, “We planned to call all of our witnesses on Wednesday.

Daily Post report that, The tribunal subsequently allowed the first respondent (INEC), second respondent (Uba Sani), and third respondent (APC) three days each for the opening and closing of their cases, taking into account the number of witnesses they had lined up.

The tribunal claims that it appears that the Counsels (INEC) are attempting to squander the tribunal’s time.   

In response to arguments made by each counsel, the three-person tribunal panel ordered INEC to begin and conclude its case on Wednesday and urged the counsels to work with the tribunal.

The petition with the reference number EPT/KD/Gov/4/23 has been postponed to the following Wednesday, August 9, 2023.
