Federal Government Appeals Order Granting CBN Governor Godwin Emefiele Bail

Today at the Federal High Court in Lagos, the battle to gain legal custody of suspended Central Bank of Nigeria (CBN) Governor Godwin Emefiele will resume. There will be two new petitions for review from the banks and the federal government. The government’s first application, submitted on August 3, asks for permission to appeal Justice Nicholas Oweibo’s vacation judge judgment, which granted Emefiele bail on July 25.

In the second, Emefiele, who filed it on August 8, asks the court to halt any further legal action the Federal Government may take against him for allegedly possessing a gun and ammunition illegally or for any other offense.

Nkiru Jones-Nebo, a deputy director of public prosecutions for the Federation, submitted the application on behalf of the federal government.

In it, the government also urged the court to issue an order keeping Emefiele in the care of the State Service Service (SSS) rather than the Nigerian Correctional Service (NCoS) and to ask the court to postpone the enforcement of that order.

Emefiele was granted N20,000,000 bail on a two-count allegation of illegal possession of firearms and ammunition by vacation judge Justice Oweibo on July 25.

In anticipation of him meeting his bail requirements, he ordered his detention at the Ikoyi Correctional Facility. However, the SSS re-arrested the troubled bank’s CEO after he fought against NCoS representatives on the court’s grounds.

Emefiele submitted the second application through a group of attorneys under the direction of Senior Nigerian Advocate Joseph Daudu.

The banker claims that this is in “brazen disobedience” of the court’s ongoing rulings releasing him on bail on July 25, 2023, and is also asking for an order of the court to clear him of all allegations made against him by the government.
