No elected President has ever lost in the Supreme Court, none since we started democracy-James Ezike

James Ezike, a Nigerian lawyer, has raised concerns about President Bola Tinubu’s trip to India just before the judgment of the Presidential election tribunal. Ezike commented on the recent verdicts delivered by the judges at the PEPT, stating that it was not surprising as no court has ever removed a sitting president since the beginning of democracy in the 4th republic.

He said in an interview with Arise Tv news, ”It’s highly suspicious that Bola Tinubu traveled to India on the eve of the judgement. Without being worried that behind his back, they may say he lost the election. He’s in a foreign land. But what I would like to say more importantly is that it’s not unexpected, no elected President has ever lost in the Supreme Court, none since we started democracy. And that is worrisome. And another thing that makes it difficult for an incumbent to be defeated is that we change our laws.” 

Regarding the chances of the petitioners at the Supreme Court, he expressed doubt and stated that it would be a pleasant surprise if there was any change. He mentioned that most of the judges in the Supreme Court do not possess the same qualities as Justice Oputa or Justice Eso, who would thoroughly examine the case and interpret it correctly.

He acknowledged the risk involved in making such a statement as a lawyer who frequently appears in court. However, he emphasized that the safety of the people is more important than flattering the judges. He also mentioned having a few friends among the judges, but the issue lies in the level of legal interpretation and the problem of excessive focus on counting days, which he believes is incorrect.
